Terms & Conditions

These Terms & Conditions apply when you use the Hello Youngster website or purchase products from Hello Youngster.
Hello Youngster is a registered business operated by Big Idea Ventures Pty Ltd, ABN 26 680 582 101.
By placing an order with us, you agree to these Terms & Conditions together with any other terms that apply to your purchase, including our Shipping Policy, Returns, Refunds & Store Credit Policy and Privacy Policy.
Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies you have under the Australian Consumer Law or any other rights that cannot lawfully be excluded. Online customers have the same basic consumer rights as other customers. (ACCC)
1. Our website
We aim to keep the information on our website accurate and current.
From time to time, information may contain errors or become outdated, including product descriptions, photographs, pricing, stock availability, release dates, supplier availability, delivery estimates or other information.
If we identify a material error affecting an order, we will contact you and explain the available options.
We may update, change or remove website content as our products, suppliers, services or business change.
2. Product information
We aim to describe and display products as accurately as reasonably possible.
Colours, dimensions, packaging and appearance may vary slightly from images because of manufacturing changes, screen displays, supplier photography or packaging updates.
Where a product is sold in an assortment, variant or randomly selected design, this will be stated where reasonably practicable.
Product packaging, specifications or included components may occasionally change without advance notice from the manufacturer or supplier.
Nothing in this section limits your rights where a product does not meet the consumer guarantees under the Australian Consumer Law.
3. Product availability
Products may have different availability states:
AVAILABLE NOW – physically in stock and available now.
AVAILABLE TO ORDER – available from a supplier and ordered for you after purchase.
PRE-ORDER – NEW RELEASE – an upcoming product that has not yet been released or delivered.
SOLD OUT – not currently available to purchase.
Availability information is based on the information reasonably available to us at the time.
For AVAILABLE TO ORDER and PRE-ORDER products, supplier stock, release dates and delivery timing can change after an order is placed.
If we become unable to supply a product you have ordered, or there is a material change to expected fulfilment, we will contact you and provide an appropriate solution, which may include cancelling and refunding the affected product where necessary.
A business that cannot supply goods that have been paid for must provide an appropriate solution rather than simply retaining the customer's money. (ACCC)
4. Orders
Placing an order through our website is an offer to purchase the products in that order.
An order is accepted when we confirm the order and process it for fulfilment, subject to product availability, payment approval and any other applicable conditions disclosed before purchase.
We may contact you if we need further information to process an order.
We may refuse or cancel an order where reasonably necessary, including where:

payment cannot be authorised

there is an obvious pricing or product-listing error

the product is unavailable

supplier allocation is withdrawn or unavailable

we reasonably suspect fraud or misuse

fulfilment is not reasonably possible.
If we cancel an order after payment has been taken, we will refund the relevant amount using the original payment method unless another arrangement is agreed with you.
5. Pricing
Prices are shown in Australian dollars and include GST where applicable.
Prices may change from time to time.
The price charged for an order is the price shown and accepted at checkout, subject to correction of obvious errors.
If an obvious pricing error affects an order, we will contact you before fulfilment and explain the options available, which may include purchasing at the correct price or cancelling the affected item for a refund.
We will not use pricing-error provisions to avoid honouring an otherwise valid purchase simply because we later decide the product should have been priced differently.
6. Payment
Available payment methods are displayed at checkout.
These may include credit or debit card, PayPal, Afterpay, Zip and other payment services.
Some payment methods are provided by independent third parties and are also subject to the provider's terms, eligibility requirements and privacy practices.
Using a Buy Now Pay Later service does not alter your rights under the Australian Consumer Law or our applicable returns policy.
7. Shipping, delivery and collection
Available shipping, local delivery, courier and Click & Collect options are described in our Shipping Policy and Delivery & Pickup information.
Delivery and collection timeframes are estimates unless expressly stated otherwise.
Some orders contain products with different availability or fulfilment timing. We will generally send or prepare the order once all products are available unless another arrangement is made.
Additional charges may apply if you ask us to split an order into separate deliveries.
8. Click & Collect and courier collection
Please wait until we confirm an order is ready before coming to collect it or arranging a courier.
Where you arrange your own courier or collection service, you are responsible for arranging and paying that provider.
Our responsibility is to make the confirmed order available for collection at the agreed location.
9. Returns, refunds and store credit
Returns, refunds and store credits are governed by our Returns, Refunds & Store Credit Policy.
Our discretionary change-of-mind policy is separate from your rights under the Australian Consumer Law.
We do not use change-of-mind exclusions, sale conditions or other store policies to remove statutory rights relating to faulty or otherwise non-compliant products. (ACCC)
10. Gift cards and store credit
Gift cards and store credits may be subject to specific terms provided when they are issued or purchased.
They are not redeemable for cash except where required by law.
Lost or stolen gift cards or store-credit information should be reported to us as soon as possible. We may require reasonable information to verify ownership or entitlement before taking action.
11. Promotions and discount codes
Promotions may be subject to additional terms displayed with the offer.
Unless otherwise stated:

promotional offers apply only during the stated promotional period

discount codes must be entered before completing checkout

promotions cannot necessarily be combined

exclusions may apply to particular products, brands, categories or fulfilment methods

free-shipping thresholds are calculated according to the terms of the relevant offer.
Campaign-specific terms will prevail over these general promotional conditions where there is an inconsistency.
Nothing in a promotional term limits your statutory consumer rights.
12. Pre-owned products
Some products sold through Hello Youngster, including Second Play Toys and pre-owned collectables, have previously been owned or used.
Their condition will be described or disclosed before purchase where relevant.
Normal wear, imperfections or characteristics that were clearly disclosed before purchase do not constitute an undisclosed defect.
Pre-owned products are not eligible for change-of-mind returns under our policy, but applicable rights under the Australian Consumer Law continue to apply.
13. Product safety and age recommendations
Age recommendations, warnings and safety information provided on products or their packaging should be followed.
Children should use products with appropriate adult supervision where required.
Parents, carers and purchasers are responsible for considering whether a product is suitable for the intended user, taking into account age, developmental stage and any relevant safety information.
This does not limit any obligations Hello Youngster has under applicable product-safety or consumer law.
14. Intellectual property
Unless otherwise stated, website content created by or for Hello Youngster, including text, graphics, branding, layout and original images, is owned by or licensed to Big Idea Ventures Pty Ltd.
Third-party trademarks, product photographs and brand materials remain the property of their respective owners.
You may use the website for personal shopping and informational purposes.
You must not reproduce or commercially exploit our original website content without permission, except where permitted by law.
15. Reviews and customer content
If you submit a review, photograph, comment or other content to us, you confirm that you have the right to provide that content.
We may display genuine customer content for purposes connected with Hello Youngster, subject to any permissions required.
We will not knowingly publish fake or misleading reviews or materially alter a review in a way that misrepresents the customer's opinion.
16. Third-party services and links
Our website may connect to third-party services such as payment providers, delivery providers, social platforms and other websites.
Those services are operated independently and may have their own terms and privacy policies.
We are not responsible for the operation of a third-party service, except to the extent that responsibility cannot lawfully be excluded.
17. Website availability
We aim to keep our website available and functioning but cannot guarantee uninterrupted access.
Maintenance, technical faults, service-provider interruptions or other circumstances may occasionally affect access.
Where an outage affects an existing order, we will continue to deal with that order and any customer rights that apply.
18. Liability
To the maximum extent permitted by law, we are not responsible for loss caused by circumstances outside our reasonable control or by use of our website or products in a manner inconsistent with their intended use or disclosed instructions.
However, nothing in these Terms excludes or limits liability, guarantees, warranties, rights or remedies that cannot lawfully be excluded or limited, including rights under the Australian Consumer Law.
19. Changes to these Terms
We may update these Terms & Conditions from time to time to reflect changes to our business, website, services or legal obligations.
Changes apply prospectively from the date the updated Terms are published.
Terms applicable to a completed purchase will not be retrospectively changed to remove rights or materially worsen the agreed conditions of that purchase.
That qualification is important because standard-form consumer contracts are subject to unfair-contract-term protections, including scrutiny of terms allowing only one party to change a contract. (ACCC)
20. Governing law
These Terms are governed by the laws applicable in Victoria, Australia.
Nothing in this provision restricts any rights a customer may have under applicable Australian law.
